We have appointed a designated Information Officer as required by section 55 of POPIA, who is responsible for ensuring compliance with the Act and handling all data subject requests, complaints, and queries. Special Personal Information (Section 26 of POPIA)

Where we are required to collect special personal information (such as health information or disability status), we will do so only with your explicit consent, where required by law, or where it is necessary to carry out our legal obligations, and we will apply enhanced safeguards to its processing and storage.

We use your personal information only for the purposes for which it was collected or for compatible purposes that you would reasonably expect. The primary purposes include:

Lawful Basis for Processing

In accordance with section 11 of POPIA, we will only process your personal information if at least one of the following lawful grounds applies:

  • Consent (Section 11(1)(a))

    You have freely given, specific, informed, and unambiguous consent to the processing of your personal information for one or more specific purposes.

  • Contractual Necessity (Section 11(1)(b))

    Processing is necessary for the performance of a contract to which you are party, or to take steps at your request prior to entering into a contract (e.g. enrolment, registration, training agreement).

  • Legal Obligation (Section 11(1)(c))

    Processing is necessary for compliance with a legal obligation to which Real Skills Technical FET College is subject, including reporting to SETA bodies and DHET.

  • Legitimate Interest (Section 11(1)(f))

    Processing is necessary for pursuing our legitimate interests or those of a third party, provided such interests are not overridden by your rights and interests.

  • Vital Interests (Section 11(1)(d))

Cross-Border Transfers (Section 72 of POPIA)

Where your personal information is transferred to a third party in a foreign country, we will ensure such transfers comply with Section 72 of POPIA, meaning the recipient country provides an adequate level of protection or appropriate safeguards are in place, including binding contractual clauses.

Upon expiry of the applicable retention period, personal information will be securely destroyed, deleted, or de-identified in a manner that prevents reconstruction or unauthorised access.

Your Rights as a Data Subject

POPIA grants you specific rights regarding your personal information. Real Skills Technical FET College is committed to upholding these rights and will respond to all valid requests within 30 days of receipt, unless an extension is required and communicated to you.

  • Right of Access (Section 23)

    You have the right to request confirmation of whether we hold your personal information and to receive a copy of that information.

  • Right to Correction (Section 24)

    You have the right to request the correction, deletion, destruction, or de-identification of inaccurate, irrelevant, excessive, outdated, incomplete, or misleading information.

  • Right to Erasure / Deletion (Section 24)

    Subject to our legal retention obligations, you may request that we delete or destroy your personal information where processing is no longer justified.

  • Right to Object (Section 11(3))

    You have the right to object, on reasonable grounds, to the processing of your personal information, in particular where processing is based on legitimate interest or for direct marketing purposes.

  • Right to Withdraw Consent (Section 11(2))

    Where processing is based on your consent, you may withdraw that consent at any time. Withdrawal does not affect the lawfulness of processing before withdrawal.

  • Right to Opt Out of Direct Marketing (Section 69)

    You have the right to opt out of receiving direct marketing communications at any time by contacting us or using the unsubscribe mechanism in our communications.

  • Right to Complain (Section 74)

    You have the right to submit a complaint to the Information Regulator of South Africa if you believe your personal information rights have been infringed.

To exercise any of the above rights, please submit a written request to our Information Officer using the contact details in Section 14 of this policy. We may require proof of identity before processing your request.

In the event of a security compromise involving your personal information, Real Skills Technical FET College will notify you and the Information Regulator as soon as reasonably possible after discovery of the compromise, as required by law.

Children's Privacy

Real Skills Technical FET College takes the protection of children's personal information very seriously. In accordance with Section 35 of POPIA, we will not process the personal information of children (persons under the age of 18) without the prior verifiable consent of a competent person — being the child's parent or legal guardian.

Where a learner is under the age of 18, we require a parent or guardian to complete and sign relevant consent forms before registration. If we become aware that we have inadvertently collected personal information from a child without appropriate consent, we will take immediate steps to delete such information.

Parent / Guardian Consent Required

If you are under 18 years of age and wish to apply for or enrol in a programme, please ensure your parent or legal guardian is involved in the application and registration process. Enrolment cannot be completed without their written consent.

Changes to This Privacy Policy

Real Skills Technical FET College reserves the right to update, amend, or replace this Privacy Policy at any time to reflect changes in our data processing practices, applicable law, or regulatory requirements. The most current version will always be available on our website at www.realskillzacademy.co.za/privacy-policy.

Where material changes are made to this policy, we will notify registered learners and users via email or a prominent notice on our website. We encourage you to review this policy periodically.
